Pursuant to Art. 13 et seq. EU Reg. no. 2016/679 (General Data Protection Regulation – GDPR), with regard to the personal data collected to enable your participation in the webinar you have selected, we provide you with the following information.

The company B. Braun Avitum Italy S.p.A., as Data Controller, and the company Clarius Med S.r.l., as Data Processor, recognise the importance of the protection of personal data and consider its protection as one of the main objectives of their activity.

Before communicating any personal data, the Controller and the Processor invite you to read this privacy policy carefully, as it contains important information on the protection of personal data and on the security measures adopted to guarantee their confidentiality in full compliance with the applicable legislation.

This privacy policy is intended only with reference to the digital event organized by B. Braun Avitum Italy S.p.A. on the site www.bbraun-meet.com and does not apply to other websites that may be consulted via external links.

The Controller and the Processor inform you that the processing of your personal data will be based on the principles of lawfulness, correctness, transparency, purpose limitation and storage, data minimization, accuracy, integrity and confidentiality. Your personal data will therefore be processed in accordance with the provisions of the applicable legislation and the confidentiality obligations therein.

2. Personal Data

“Personal Data” shall mean any information relating to an identified or identifiable natural person with particular reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more characteristics of his physical, physiological, mental, economic, cultural or social identity.

The computer systems and software procedures used to operate the site acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified interested parties, but by its very nature could, through processing and association with data held by third parties, allow users to be identified. This category of data includes the IP addresses or domain names of the computers used by users connecting to the site, the URI (Uniform Resource Identifier) addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the user’s operating system and computer environment. These data are used only to obtain anonymous statistical information on the use of the site and to check its correct functioning and are deleted after processing. The data could be used to ascertain responsibility in case of hypothetical computer crimes against the site.

Data provided voluntarily by the user

This is data voluntarily provided by the user to register for the webinar (e.g. name – surname – organisation – email address – password, etc.).

Cookies

A cookie is a textual element that is placed on the hard drive of a computer only after authorisation. Cookies have the function of streamlining the analysis of web traffic or signalling when a specific site is visited and allow web applications to send information to individual users. No personal user data is acquired by the website in this respect. We do not use cookies to transmit information of a personal nature, nor do we use so-called persistent cookies of any kind, i.e. systems for tracing users. The use of so-called session cookies is strictly limited to the transmission of session identifiers (consisting of random numbers generated by the server) necessary to enable the safe and efficient exploration of the site. The so-called session cookies used on the site avoid the use of other computer techniques that could potentially compromise the confidentiality of users’ browsing and do not allow the acquisition of personal data identifying the user.

Purposes of data processing

The Personal Data you provide through the site will be processed by the Data Controller and the Data Processor for the following purposes:

  1. to finalize your registration and participation in the webinar;
  2. to better organize and deliver the webinar;
  3. to optimize the Controller’s business activities and to obtain feedback (ex post) on the webinar promotion activities previously carried out;
  4. to perform research/statistical analysis on aggregate or anonymous data, without therefore the possibility of identifying the user, aimed at measuring the functioning of the website, measuring traffic and assessing usability and interest;
  5. purposes related to the fulfilment of a legal obligation to which the Data Controller or Data Processor is subject;
  6. purposes necessary to ascertain, exercise or defend a right in court or whenever the judicial authorities exercise their judicial functions;
  7. to contact you to invite you to other events organized by B. Braun

The legal basis for the processing of Personal Data for the purposes referred to in points a) and b) is the fulfilment of pre-contractual and contractual measures taken at your request for the purpose of your registration and participation in the webinar.

The legal basis for the processing of Personal Data for the purposes referred to in point c) is the legitimate interest of the Controller.

The purpose referred to in point d) does not involve the processing of personal data, whereas the purposes referred to in points e) and f) constitute lawful processing of personal data within the meaning of the applicable legislation since, once the personal data have been provided, processing is necessary in order to comply with a legal obligation to which the Data Controller or Data Processor is subject.

The processing of your personal data for the purposes referred to in points (g) and (h) will be carried out by the Controller only with your consent. This consent may be revoked at any time by contacting the Controller at the address indicated in this notice, without prejudice to any processing carried out prior to revocation of consent.

3. Compulsory/optionality of data provision

 

The provision of your personal data for the purposes listed above in points (a) to (f) is optional, but failure to provide such data may make it impossible for you to participate in the webinar of your choice or to comply with a legal obligation to which the Data Controller or Data Processor is subject.

Consent to the processing of data for the purposes referred to in points (g) and (h) is optional; failure to consent does not affect your ability to participate in the webinar of your choice.

4. Recording

The webinar will be recorded and the recording may be used by the Data Controller for information, training or promotional purposes by publication on its website, social networks or other means of communication. If you do not want your image and voice to be recorded, please do not activate your webcam and microphone and only use the “chat” function if you wish to intervene during the event.

5. Data Recipient

Your personal data may be disclosed, to the extent necessary to fulfil the above purposes, to:

  1. subjects whose intervention is necessary for the provision of services offered by the Site including, by way of example, the analysis of the operation of the site acting as data processors;
  2. persons authorized by the Data Controller or the Data Processor to process personal data who are committed to confidentiality or have a legal obligation of confidentiality (e.g. employees and collaborators of the Data Controller and the Data Processor);
  3. other companies within the B. Braun Group based in the European Union;
  4. judicial authorities in the exercise of their functions when required by applicable law.

The data are not subject to dissemination.

No automated decision-making processes are used when processing personal data for the purposes set out in this policy.

7. Data retention

The personal data collected when you navigate on the above mentioned website will be kept for the time strictly necessary to pursue the above mentioned purposes.

The Data Controller may keep your data, collected for the fulfilment of pre-contractual and contractual measures taken at your request, or to process them for the purposes referred to in paragraph 3 letters g) and h), until your consent is revoked.

The recording of the webinar will be stored by the Data Controller for 15 years.

Data is not transferred outside the European Union.

9. Data Subject rights

As a data subject in relation to the processing of your personal data, you have the right to obtain confirmation of the existence or otherwise of such data, to be informed of its content, to verify its accuracy, to access your data, to request its origin, rectification, integration, deletion, the purposes and methods of its processing, updating if incomplete, incorrect or collected in violation of the law, and to object to its processing and obtain the restriction of its processing; you have the right to transformation into an anonymous form and to blocking of data processed in violation of the law; you have the right, finally, to the portability of your data.
